Terms of Service

Welcome to CommitSure ("Platform", "we", "us", or "our"), a product of Rewinity Labs Private Limited. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Rewinity Labs Private Limited governing your access to and use of our web application, APIs, notifications, and all related services (collectively, the "Services"). By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

1. Definitions

  • "Commitment" means a structured accountability agreement created on the Platform between two parties, defining obligations, deadlines, and consequences.
  • "Creator" means the User who initiates and creates a Commitment.
  • "Fulfiller" means the party responsible for performing the obligations defined in the Commitment. The Creator may also be the Fulfiller.
  • "Counterparty" or "Accountability Partner" means the other party in a Commitment who holds the Fulfiller accountable.
  • "Reviewer" means the party responsible for verifying completion of a Commitment.
  • "Platform Fees" means activation fees, dispute fees, appeal fees, reattempt fees, reinstatement fees, and any other charges levied by CommitSure for use of the Services.
  • "Credits" means prepaid balances purchased through the Platform's wallet system and used toward Platform Fees.

2. Eligibility

To use CommitSure, you represent and warrant that you:

  • Are at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into binding agreements
  • Will provide accurate, current, and complete registration information
  • Are not prohibited from using the Services under any applicable law
  • Will maintain the security and confidentiality of your account credentials
  • Will not create more than one account per individual

3. User Accounts and Security

3.1 You may register using email/password or Google OAuth. You are solely responsible for all activities that occur under your account.

3.2 You must notify us immediately at support@commitsure.com if you suspect unauthorized access to your account. CommitSure is not liable for any loss arising from unauthorized use of your account where you have failed to maintain adequate security.

3.3 We reserve the right to suspend, disable, or terminate any account at our sole discretion if we believe the account is being used in violation of these Terms, for fraudulent activity, or for any activity that threatens the integrity of the Platform.

4. Nature of the Platform

IMPORTANT: CommitSure is a technology platform that facilitates accountability-based agreements between Users. CommitSure is not a party to any Commitment created on the Platform. We act solely as an intermediary providing tools for commitment creation, tracking, and dispute resolution. We do not guarantee the performance, reliability, or conduct of any User.

4.1 CommitSure does not endorse, verify the accuracy of, or assume responsibility for any Commitment, its terms, or its outcome.

4.2 All interactions, obligations, and transactions between Users are solely between those Users. CommitSure bears no liability for any acts, omissions, errors, or defaults of any User.

4.3 CommitSure does not provide legal, financial, or advisory services. Users should seek independent professional advice before entering into Commitments involving significant financial or legal obligations.

5. Commitments and Lifecycle

5.1 Creation: Users may create Commitments specifying obligations, deadlines, verification metrics, consequences, and payment responsibility. The Creator may designate themselves as either the Fulfiller or the Requester. All details provided must be accurate and not misleading.

5.2 Acceptance: A Commitment becomes active only when the accepting party (Fulfiller or Counterparty, depending on the flow) accepts it. Acceptance constitutes agreement to all terms of the Commitment, including deadlines and consequences. Once a Commitment is accepted, the activation fee is non-refundable.

5.3 Negotiation: Before acceptance, the receiving party may propose modifications through the negotiation process. Negotiations are limited to a maximum number of rounds as configured by the Platform.

5.4 Modifications and Extensions: After acceptance, either party may request modifications or deadline extensions. Such requests require approval from the other party and are subject to Platform-defined limits.

5.5 Completion and Review: The Fulfiller marks a Commitment as complete by providing proof. The Reviewer has a 24-hour window to accept the completion or raise a dispute. If no action is taken within 24 hours, the completion is auto-accepted.

5.6 Cancellation and Withdrawal: Cancellation or withdrawal of an active Commitment requires approval from the other party and may be subject to penalties. Commitments in pending status may be cancelled directly by the Creator.

5.7 Consequences: Failure to fulfill a Commitment may result in consequences as defined at creation, including but not limited to: increased Platform Fee multipliers, category lockouts (30 days, 3 months, or 6 months), and reputation score decreases. These consequences are applied automatically and are non-negotiable.

6. Fees, Payments, and Credits

6.1 Platform Fees: CommitSure charges the following fees for use of the Services:

  • Activation Fee: A one-time fee charged when a Commitment is accepted. The base fee varies by country and may be subject to a multiplier based on the User's failure history (up to 16x).
  • Dispute Fee: Charged when a party raises a dispute
  • Appeal Fee: Charged when filing an appeal against a failed Commitment.
  • Reattempt Fee: Charged when requesting to re-attempt a failed Commitment.
  • Reinstatement Fee: Charged to remove a category lockout before its natural expiry.

6.2 Non-Refundable: All Platform Fees are non-refundable once paid, except in cases of verifiable technical error or duplicate charges. See our Refund Policy for details.

6.3 Credits and Wallet: Users may purchase Credits through our wallet system. Credits are non-refundable, non-transferable, and have no cash value. Credits may be used only toward Platform Fees. We reserve the right to modify Credit pricing at any time.

6.4 Payment Processing: All payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway. CommitSure does not store your payment card information. By making a payment, you agree to Razorpay's terms of service.

6.5 Fee Changes: We reserve the right to modify fee structures at any time. Changes will be communicated via the Platform and will apply to Commitments created after the effective date of the change.

7. Identity Verification (KYC)

7.1 To ensure trust and safety, CommitSure requires identity verification before Users can create Commitments. Verification documents may include government-issued identification (Aadhaar, PAN, Passport, etc.) and a selfie for identity confirmation.

7.2 You represent that all verification documents submitted are genuine, belong to you, and are not altered or falsified. Submitting fraudulent documents is a violation of these Terms and may result in immediate account termination and reporting to relevant authorities.

7.3 Verification documents are processed securely and stored in accordance with our Privacy Policy. Verification status may be revoked at any time if we suspect irregularities.

8. Dispute Resolution

8.1 If a Reviewer is not satisfied with the completion of a Commitment, they may raise a dispute within the review window by paying the applicable Dispute Fee and providing evidence supporting their position.

8.2 The Fulfiller will have the opportunity to respond with counter-evidence. Our admin team will review all evidence and render a decision.

8.3 Binding Decision: Dispute decisions made by CommitSure's admin team are final and binding on both parties. You acknowledge and agree that CommitSure's dispute resolution is an internal Platform process and does not constitute legal arbitration or adjudication. Users retain their right to pursue legal remedies independently.

8.4 CommitSure reserves the right to decline to resolve disputes that involve illegal activity, and may report such matters to appropriate authorities.

8.5 Repeated frivolous or abusive disputes may result in account restrictions or termination.

9. Prohibited Activities and Anti-Gaming

You agree not to:

  • Use the Platform for any illegal, fraudulent, or deceptive purpose
  • Create fake, misleading, or sham Commitments to manipulate reputation scores
  • Create Commitments with yourself (self-commitments) or with related/colluding parties to artificially inflate reputation
  • Use multiple accounts, email aliases, or related email patterns to circumvent anti-gaming measures
  • Harass, threaten, defame, or abuse other Users
  • Attempt to circumvent security measures, rate limits, or access restrictions
  • Upload malicious code, viruses, or attempt to disrupt Platform operations
  • Scrape, crawl, or use automated tools to access the Platform without authorization
  • Impersonate another person, entity, or misrepresent your affiliation
  • Use the Platform to launder money or engage in financial fraud
  • Interfere with or manipulate the dispute resolution process
  • Resell, sublicense, or commercially exploit the Platform without authorization

CommitSure employs automated anti-gaming detection systems that may flag or restrict accounts exhibiting suspicious patterns. Violations may result in immediate account suspension, reputation penalties, or permanent ban without prior notice.

10. Developer API and Integrations

10.1 CommitSure provides APIs for third-party developers to integrate Commitment functionality into their applications. Use of the API is subject to these Terms, our API documentation, and any additional API-specific terms.

10.2 API keys and secrets are confidential. You are responsible for securing your API credentials and all activity conducted through them.

10.3 We reserve the right to impose rate limits, suspend API access, or revoke API keys at any time for misuse, abuse, or violation of these Terms.

10.4 Webhook data delivered to your endpoints is provided "as is". You are responsible for verifying webhook signatures and securing your endpoints.

11. Communications and Notifications

11.1 By using CommitSure, you consent to receive transactional emails, in-app notifications, and (if opted in) WhatsApp messages related to your Commitments, account activity, and Platform operations. These are essential service communications and cannot be opted out of while maintaining an active account.

11.2 You may manage your notification preferences in your account settings. Marketing communications, if any, will include an unsubscribe mechanism.

12. Intellectual Property

12.1 All content, features, functionality, design elements, trademarks, logos, and software comprising CommitSure are owned by Rewinity Labs Private Limited and are protected by copyright, trademark, patent, and other intellectual property laws.

12.2 You retain ownership of content you submit to the Platform (Commitment descriptions, proof of completion, etc.), but grant CommitSure a non-exclusive, worldwide, royalty-free license to use, store, and display such content as necessary to provide the Services.

12.3 You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works from any part of the Platform without our express written consent.

13. Disclaimers

13.1 THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13.2 COMMITSURE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

13.3 COMMITSURE DOES NOT GUARANTEE THE IDENTITY, RELIABILITY, HONESTY, OR CONDUCT OF ANY USER. YOU INTERACT WITH OTHER USERS AT YOUR OWN RISK.

14. Limitation of Liability

14.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMMITSURE, ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

14.2 COMMITSURE IS NOT LIABLE FOR:

  • The fulfillment or non-fulfillment of any Commitment by any User
  • Disputes between Users or the outcome of any Commitment
  • Any damages arising from User-to-User interactions
  • Service interruptions, downtime, or data loss
  • Third-party payment processor errors or failures
  • Actions taken by Users based on information obtained through the Platform
  • Loss or theft of User credentials

14.3 OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF PLATFORM FEES PAID BY YOU TO COMMITSURE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 5,000, WHICHEVER IS GREATER.

15. Indemnification

You agree to indemnify, defend, and hold harmless CommitSure, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any Commitment you create, accept, or participate in; or (e) any content you submit through the Platform.

16. Termination

16.1 We may suspend or terminate your account at any time, with or without cause and with or without notice, for violation of these Terms, fraudulent activity, anti-gaming violations, or any conduct we determine is harmful to the Platform or other Users.

16.2 You may request account deletion through your settings. However, active Commitments must be resolved (completed, cancelled, or failed) before deletion can be processed. Outstanding fees must be settled.

16.3 Upon termination, your right to use the Services ceases immediately. Sections regarding liability, indemnification, intellectual property, and governing law survive termination.

16.4 Credits remaining in your wallet at the time of account termination are forfeited and non-refundable.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Platform at least 15 days before taking effect. Your continued use of CommitSure after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Services and close your account.

18. Governing Law and Jurisdiction

18.1 These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

18.2 Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar, India.

18.3 Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation for a period of at least 30 days.

19. General Provisions

19.1 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19.2 Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision.

19.3 Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and CommitSure regarding the Services and supersede all prior agreements.

19.4 Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

19.5 Force Majeure: CommitSure shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, pandemic, government actions, or internet/infrastructure failures.
